  3. By using this software you accept the following 
  4. terms of this License Agreement. If you do not

  8. Ownership

  10. Red Dragon International, Inc. ("Red Dragon") 
  11. retains the ownership of this copy of the 
  12. enclosed software package. It is licensed 
  13. to you for use under the following conditions:

  15. Grant of License
  16. ================
  17. You may use the enclosed copy of the software 
  18. package on any number of computers at any time 
  19. for the time period set forth in this package.
  20.  
  21. You may freely distribute this software in 
  22. unmodified form, as long as other users read 
  23. and agree fully to the terms of this license.
  24.  
  25. You must not remove or alter any copyright 
  26. notices on all copies of the software package.
  27.  
  28. This grant terminates when the time period 
  29. within the software expires, or December 31, 2003, 
  30. whichever comes first.  Red Dragon may, at its
  31. sole discretion, choose to replace this product
  32. along with new terms and conditions, which may
  33. include a new termination date.

  36. Customer Support Services
  37. =========================
  38. Red Dragon may provide you with support services 
  39. ("Support Services") related to the software 
  40. package. Any additional software code (including 
  41. updates and enhancements) provided to you as 
  42. part of Support Services shall be considered 
  43. part of the software package and subject to 
  44. the terms and conditions of this Agreement. 
  45.  
  46. Any technical information, suggestions, ideas, 
  47. and concepts you provide to Red Dragon as part 
  48. of the Support Services may be used by Red Dragon
  49. for its business purposes, including for 
  50. product support and development. Red Dragon 
  51. will not utilize such technical information 
  52. in a form that personally identifies you.

  55. Restrictions
  56. ============
  57. You may not rent, sub-license or lease the 
  58. software or documentation, including 
  59. translating, decompiling, disassembling, 
  60. or creating derivative works. You may not 
  61. reverse-engineer any part of this software, 
  62. or produce any derivative work.

  64.  
  65. Termination
  66. ===========
  67. This license and your right to use this 
  68. software automatically terminates if you 
  69. fail to comply with any provision of this 
  70. license agreement.

  73. Rights
  74. ======
  75. Red Dragon retains all rights not expressly 
  76. granted. Nothing in this license agreement 
  77. constitutes a waiver of Red Dragon's rights 
  78. under the U.S. copyright laws or any other 
  79. Federal or State law.

  82. Limited Warranty
  83. ================
  84. Red Dragon excludes any and all implied 
  85. warranties, including warranties of 
  86. merchantability and fitness for a particular 
  87. purpose and limits your remedy to return the 
  88. software and documentation to Red Dragon for 
  89. replacement. Although Red Dragon has tested 
  90. the software and reviewed the documentation, 
  91. RED DRAGON MAKES NO WARRANTY OF REPRESENTATION, 
  92. EITHER EXPRESSED OR IMPLIED, WITH RESPECT 
  93. TO THIS SOFTWARE OR DOCUMENTATION, ITS 
  94. QUALITY, PERFORMANCE, MERCHANTABILITY, 
  95. OR FITNESS FOR A PARTICULAR PURPOSE. RED DRAGON
  96. MAKES NO WARRANTY OF REPRESENTATION, EITHER 
  97. EXPRESS OR IMPLIED, WITH RESPECT TO ANY OTHER 
  98. SOFTWARE REFERRED TO WITHIN THE PRODUCT OR ON 
  99. THE RED DRAGON WEBSITE, ITS QUALITY, PERFORMANCE, 
  100. MERCHANTABILITY, OR FITNESS FOR A PARTICULAR 
  101. PURPOSE. AS A RESULT, THIS SOFTWARE AND 
  102. DOCUMENTATION ARE LICENSED "AS IS" AND YOU, 
  103. THE LICENSEE, ARE ASSUMING THE ENTIRE RISK 
  104. AS TO ITS QUALITY AND PERFORMANCE. IN NO 
  105. EVENT WILL RED DRAGON BE LIABLE FOR DIRECT, 
  106. INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL 
  107. DAMAGES ARISING OUT OF THE USE OR INABILITY 
  108. TO USE THE SOFTWARE OR DOCUMENTATION, even if 
  109. advised of the possibility of such damages. 
  110. In particular, Red Dragon shall have 
  111. no liability for any data stored, processed, 
  112. or deleted by this software, including the 
  113. costs of recovering such data.

  115. THE WARRANTY AND REMEDIES SET FORTH ABOVE ARE 
  116. EXCLUSIVE AND IN LIEU OF ALL OTHERS, ORAL OR 
  117. WRITTEN, EXPRESSED OR IMPLIED. No Red Dragon
  118. dealer, agent, or employee is authorized to make 
  119. any modifications or additions to this warranty.

  121. Information in this document is subject to change 
  122. without notice and does not represent a commitment 
  123. on the part of Red Dragon. The software 
  124. described in this document is furnished under 
  125. this license agreement. The software may be used 
  126. or copied only in accordance with the terms of 
  127. the agreement. It is against the law to copy the 
  128. software on any medium except as specifically 
  129. allowed in the license agreement.

  131. Some states do not allow the exclusion of implied 
  132. warranties or liability for incidental or 
  133. consequential damages, so the above limitation 
  134. or exclusion may not apply to you. This warranty 
  135. gives you specific legal rights, and you may also 
  136. have other rights which vary from state to state.

  138. GENERAL
  139. This Agreement is binding on you as well as your 
  140. employees, employers, contractors and agents, and 
  141. on any successors and assignees.  Neither the 
  142. Software nor any information derived therefrom 
  143. may be exported except in accordance with the 
  144. laws of the U.S. or other applicable provisions.  
  145. This Agreement is governed by the laws of the 
  146. State of Colorado (except to the extent federal 
  147. law governs copyrights and federally registered 
  148. trademarks). This Agreement is the entire 
  149. agreement between us and supersedes any other 
  150. understandings or agreements, including, but 
  151. not limited to, advertising, with respect to 
  152. the Software.  
  153. If any provision of this Agreement is deemed 
  154. invalid or unenforceable by any country or 
  155. government agency having jurisdiction, that 
  156. particular provision will be deemed modified 
  157. to the extent necessary to make the provision 
  158. valid and enforceable, and the remaining 
  159. provisions will remain in full force and effect.
